Paul Murphy Accuses Developer of Bullying Tidy Towns Group

Paul Murphy raised a case of strategic litigation by Ardstone against the Ballybowden Tidy Towns Group, accusing the developer of bullying the community and attempting to silence sustainable planning. Allegations against Ardstone

Paul Murphy told the Dáil that after he raised the Ballybowden case with the Taoiseach, Ardstone sent another letter to the Ballybowden Tidy Towns Group. The letter referenced what he had said in the Dáil, alleged continued briefing against Ardstone, and demanded an undertaking not to defame Ardstone to any person, media body, TD or other entity in future.

Pattern of threats in Swords

He said Councillor Dean Mulligan brought a similar situation in Swords to his attention involving MKN Properties. According to the deputy, MKN Properties rely on McCann Fitzgerald for a judicial review while AMOS solicitors were used to threaten the South Swords residents group, which he presented as part of a broader pattern of tactics to silence residents.

Impact on public participation

Paul Murphy characterised the letters and legal threats as bullying and threatening behaviour intended to get community groups to back down from standing for sustainable planning. He warned that such strategic litigation and threatening correspondence prevent public participation in planning debates.

Question to the Taoiseach

He recalled the Taoiseach had said no one should ever intimidate a Tidy Towns Committee and asked directly what would be done to prevent this pattern of legal bullying from continuing.
